TERMS AND CONDITIONS

This page sets out the terms and conditions that apply to our members.

These Terms and Conditions create a legally binding contract between you and Saatchi Gallery. Please read them carefully.

Please note that your Membership will automatically renew at the end of each year unless you cancel that renewal.

  1.  Membership Subscription / Recurring Payments
    1. The subscription for Membership must be paid by you in advance.
    2. Your Membership lasts for one year from the date Saatchi Gallery accepts your application for Membership.
    3. Unless you send us an email to membership@saatchigallery.com telling us that you wish to cancel your Membership at least one week before it is due to end, it will be renewed automatically by charging the payment card you used to pay the initial subscription with the subscription for the following year. We will endeavour to notify you before each renewal of the renewal date and the current subscription.
    4. Saatchi Gallery has the right to increase the cost of its subscriptions at any time but any increase will be applied only to new Members and if you renew your Membership.
  2.  Benefits
    1. Membership brings the Benefits which are advertised, from time to time, on the Site and which can be seen at the following page: https://www.saatchigallery.com/join
    2. You understand and agree that Saatchi Gallery has the right to alter, add or remove any Benefits from time to time during your Membership and that it does not have to give you notice before it makes those changes.
    3. You understand that certain Benefits may be limited in both time and number and that Saatchi Gallery will not be able to fulfil any order if the time they are available expires or Saatchi Gallery has insufficient stock.
    4. Any Benefit offered cannot be used in connection with any promotion or offer made by Saatchi Gallery.
    5. Your Membership, and all entitlement to any Benefits, will end on your death or your ceasing to be a Member.
  3.  Membership Card
    1. Saatchi Gallery will supply you with a Membership Card within 60 days of accepting you as a Member.
    2. The Membership Card will, at all times, remain the property of Saatchi Gallery and you agree to give it up to Saatchi Gallery on demand.
    3. The Membership Card has no monetary value.
    4. To obtain any of the Benefits, you must at all times present your Membership Card or your Membership ID.
  4.  Your Obligations to Saatchi Gallery
    You warrant and agree that:
    1. you are over the age of 16 years;
    2. you will comply with all and any rules and regulations Saatchi Gallery apply to your visit to the Gallery;
    3. you will not give, lend, sell or in any other way attempt to transfer your Membership Card to another;
    4. all the information you have supplied to Saatchi Gallery is accurate and truthful and that you will keep any addresses and other information you have registered with Saatchi Gallery up to date; and you will not share any password with which Saatchi Gallery supplies you with any other person for any reason.
  5.  Disclaimers
    Saatchi Gallery can never promise that the Gallery, the services it provides or any of the Benefits it offers will be available to you at their advertised times or at all and Saatchi Gallery has no liability to you if the Gallery is closed or any service or Benefit is not available for any reason.
  6.  Limitation of Liability
    As far as it is allowed by law, Saatchi Gallery denies liability for any losses of all kinds which you incur from visiting and/or using the Gallery and/or any Benefit, but nothing in these Terms and Conditions excludes or restricts its liability for death or personal injury resulting from any negligence or fraud on its part.
  7.  Data Protection
    1. Saatchi Gallery will process the details you supply to it in accordance with the Data Protection Act 1998, or otherwise as permitted or required by law.
    2. You agree that Saatchi Gallery may use the information you supply to it for marketing, statistical and analytical purposes. Saatchi Gallery will not pass your personal details to third parties without your prior consent and will never sell, rent or exchange your personal details with any other organisation without your permission.
    3. Saatchi Gallery does not collect or process sensitive personal data about you such as race, ethnic origin, physical or mental health or sexual orientation.
    4. As a Member, you will receive information digitally from Saatchi Gallery. You can unsubscribe from this service by clicking the link at the bottom of any newsletter sent to you and entering your email address. Please note that by unsubscribing you may not receive information about Benefits, including but not limited to exhibitions, talks, workshops and private views.
  8.  Cancellation
    1. Subject to clause 8.2, you may cancel your Membership at any time within the period of 14 days from when Saatchi Gallery has advised you that your application for Membership has been accepted.
    2. If you use any of the Benefits during the period mentioned in clause 8.1 you will lose your right to cancel your Membership under the terms of this clause 8.
    3. If you cancel your Membership during the period mentioned in clause 8.1 (subject to clause 8.2), Saatchi Gallery will refund all monies you have paid to it as soon as it hears from you that you wish to cancel. You must send Saatchi Gallery notice in writing either by post or email before the end of the period mentioned in clause 8.1 to:

    4. You may cancel your Membership at any time after the period mentioned in clause 8.1 by giving Saatchi Gallery notice to the email or postal address contained in clause 8.3 but, in that event, Saatchi Gallery will not refund your subscription or any part of it to you.
    5. Saatchi Gallery may cancel your Membership at any time, by notice to you, if you break any of these Terms and Conditions.
  9.  The Agreement and its Formation
    1. Subject to clause 9.5, an agreement will only come into existence between you and Saatchi Gallery when Saatchi Gallery has confirmed by email that it has accepted you as a Member and, from that date, all Benefits will be available to you.
    2. Saatchi Gallery has the right to refuse any application for Membership and, if it does, it does not have to give reasons for that refusal.
    3. If Saatchi Gallery does not accept you as a Member, it will refund, in full, all monies you have paid to it using the same method you used to pay Saatchi Gallery.
    4. Both you and Saatchi Gallery agree to be bound by each section of these Terms and Conditions.
    5. If your Membership has been gifted to you, you agree to comply with these Terms and Conditions as if you had bought the subscription and the agreement between you and Saatchi Gallery will come into existence the first time you use your Membership to obtain any Benefit.
  10.  General Conditions
    1. These Terms and Conditions are made under the laws of England and Wales and that is the only jurisdiction which can govern them.
    2. Saatchi Gallery and you agree that these Terms and Conditions do not form the basis of any partnership or co-venture.
    3. These Terms and Conditions supersede any previous Terms and Conditions Saatchi Gallery has published and represent the entire understanding between you and Saatchi Gallery in relation to your Membership.
    4. Saatchi Gallery has the right to change these Terms and Conditions at any time.
    5. Time will not be of the essence in any part of any agreement between you and Saatchi Gallery.
    6. All parties acknowledge and agree that they have not entered into any agreement between them in reliance on anything said or promised by the other which is not mentioned in these Terms and Conditions and these Terms and Conditions contain the entire understanding between you and Saatchi Gallery.
    7. If a court or other body says that any part of these Terms and Conditions is unenforceable, the rest of them will stand.
    8. If either you or Saatchi Gallery need to give formal notice to the other, it must be done by email to the address each of the parties gives to the other from time to time.
    9. No third party has any rights under these Terms and Conditions.
  11.  Definitions
    The following words and phrases have the following meanings in these Terms and Conditions:
